1. Purpose of the App

OnSun is operated by Vireo Energy Pty Ltd (“we”, “our”, or “us”). The App provides solar forecasting and appliance scheduling tools to help users align energy use with solar generation. The App is for informational and educational purposes only and should not be relied upon for operational, financial, or safety-critical decisions.

2. Eligibility and account scope

The App is intended for users aged 13 and over. Some jurisdictions set a higher minimum age for consent to data processing (for example, up to 16 in parts of the EU/EEA); where that applies, you must have the consent or involvement of a parent or guardian. If you subscribe to a paid plan, you must be legally able to enter a binding contract in your jurisdiction (e.g. be of age of majority). By using the App, you represent that you meet these requirements.

3. Licence to use the App

We grant you a personal, non-exclusive, non-transferable licence to use the App for your own personal, non-commercial purposes. You may not resell, redistribute, or sublicense the App or its content. You may not reverse engineer, decompile, or disassemble the App except to the extent that applicable law expressly permits it.

4. Acceptable use

You must not misuse the App or our services. This includes: abusing or overloading the forecast or proxy services; using automated scraping, bots, or scripts to extract data; interfering with the App, our systems, or other users; or attempting to bypass rate limits, security measures, or access controls. We may suspend or block access in response to such conduct.

5. Forecast accuracy and limitations

We use third-party weather and solar data sources and our own algorithms to generate forecasts. Because solar generation depends on many uncontrollable factors, such as weather, shading, and system performance, we cannot guarantee that any forecast or suggestion will reflect actual solar output or energy savings.

You acknowledge that forecasts are estimates only, and real-world results may differ. We are not liable for any losses, damages, or missed savings resulting from reliance on forecasts or recommendations.

6. Third-party services

Forecast data (e.g. Open-Meteo), reverse geocoding, hosting, and app-store billing are provided by independent third parties. Their terms and policies apply when data or requests are sent to them. We are not responsible for their availability, accuracy, outages, changes, or errors. If a third-party service changes or becomes unavailable, we are not liable for any impact on the App.

Promotional content and affiliate links. OnSun is free to use, with an optional paid subscription. To support the free tier, the App may display promotional content and affiliate links to third‑party products, services, or offers, shown primarily to users on the free plan. These offers are selected using limited information such as your region, language, subscription status, and app usage (as described in our Privacy Policy). We may earn a commission if you take up an affiliate offer; this does not change the price you pay. Such offers are provided by independent third parties, are governed by those parties’ own terms and privacy policies, and may not be available in all regions. We do not endorse, and are not responsible for, any third‑party products, services, offers, or websites, and any dealings you have with them are solely between you and the third party. You can turn off personalised offers for free in the app’s settings (under Notifications), where that control is shown, and Pro subscribers may see fewer or no offers.

7. Device, OS, and connectivity

App performance and features depend on your device, operating system version, permissions (e.g. location), and internet access. Features may not work correctly if you deny required permissions, are offline, or use unsupported or outdated software. We are not responsible for issues caused by your device or network configuration.

8. User responsibilities

You are responsible for ensuring your site details and appliance settings are accurate. The App may provide recommendations, but you make the final decisions about when and how to operate your appliances. The App does not directly control equipment unless explicitly stated for compatible devices.

Appliance consumption estimates (approximated load profiles). The App estimates when and how much power your appliances consume using approximated load profiles. For many appliances, such as washing machines, dishwashers, clothes dryers, air conditioners, and pool pumps, the App generates a time-varying profile that approximates a typical appliance cycle (for example, a heater spike, a wash phase, rinse and spin stages, or compressor cycling). Other appliances (for example ovens, heaters, or custom appliances) use a simpler constant or "block" profile that holds power steady for the run. In every case these are approximations, not a metering replacement and not a precise real-time measurement of your specific appliance.

The profiles are calibrated against typical, publicly available appliance data (such as energy-rating registrations and energy labels) grouped by efficiency band, but both the consumption amounts and the shape of the profile are estimates only. Your actual appliance may have variable load cycles, different power draws, or efficiency ratings that differ from the profile used, and may consume meaningfully more or less than estimated depending on its model, age, settings, load size, water temperature, ambient conditions, and how you operate it. We do not guarantee the accuracy of these estimates and recommend you verify consumption against your own utility data or smart metering where available.

Electric vehicle (EV) charging estimates. For EV charging, the App estimates an EV charging profile from the charger rating, battery capacity, and the current and target state of charge you enter, applying a tapering curve and a typical charging-loss factor. This is an approximation only. Real charging behaviour varies by vehicle, charger, battery temperature and age, onboard charger limits, and charging losses, so actual energy drawn and charging time may differ materially from the estimate.

9. Subscriptions and payments

The App offers free and paid subscription plans. Paid features may include extended forecast days, unlimited appliances, and advanced insights. Subscriptions are billed through the Apple App Store or Google Play.

  • Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage and cancel subscriptions in your Apple ID or Google account settings. Cancellation stops future charges but does not refund the current period.
  • If you start a free trial, it will convert to a paid subscription at the end of the trial unless you cancel before then.
  • Subscription pricing may change; we will give notice via the platform where required. Feature availability may vary by region and platform.
  • No refunds are offered for partial subscription periods, except where required by law.

10. Data and privacy

Your privacy is important to us. To deliver its features and support the free tier, the App processes information such as your location (for forecasts), your country, language, and subscription status, aggregate app‑usage statistics, and interactions with promotional content. We do not use third‑party advertising SDKs, track you across other apps, or sell your personal data. 11. Limitation of liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies under the Australian Consumer Law (or equivalent in your jurisdiction) that cannot be excluded by law.

To the fullest extent permitted by law (and subject to the above):

  • The App and all information are provided “as is” without warranties of any kind.
  • We disclaim all implied warranties, including accuracy, reliability, or fitness for purpose.
  • We are not responsible for any loss of data, system damage, or financial loss arising from use of or reliance on the App.
  • Our total liability, if any, is limited to the amount paid (if any) for your subscription in the 12 months prior to the claim.

12. Indemnity

You agree to indemnify and hold harmless Vireo Energy Pty Ltd and its officers, directors, and employees from any claims, losses, or expenses (including reasonable legal costs) arising from your misuse of the App, unlawful use, or breach of these Terms.

13. Termination

We may suspend or terminate your access to the App or our services if you breach these Terms, including acceptable use. You may stop using the App at any time. Uninstalling the App removes locally stored data, subject to platform behaviour (e.g. iCloud or backup). We do not maintain user accounts; there is no separate “account” to delete beyond uninstalling.

14. Intellectual property

The App and its content (including design, text, software, and underlying intellectual property, excluding third-party data and materials) are owned by Adaptive Energy Group Pty Ltd or its licensors and are licensed to Vireo Energy Pty Ltd for operation and distribution.

Vireo Energy Pty Ltd operates and distributes the App under licence. Third-party trademarks, data, and content belong to their respective owners. You do not acquire any rights in our or third-party intellectual property by using the App.

15. Changes and availability

We may update, modify, or discontinue any part of the App at any time. Subscription pricing and plan features may change with notice where required (e.g. via the app store). These Terms may also be updated periodically; the effective date will be revised when they change. Continued use of the App after changes means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Victoria, Australia, and you agree to submit to the jurisdiction of the courts located in Victoria. Nothing in this clause deprives you of the protection of any mandatory consumer‑protection laws of your country of residence, or of any right you may have under local law to bring proceedings in the courts of your country of residence where such rights cannot be excluded.
